Draw Conditions

  1. ORGANIZING COMPANY

    Harper&Neyer S.L., with registered office at Calle Nabucco 11 and tax identification number B93269777, is organizing a nationwide sweepstakes (hereinafter, “the Promotion”) for promotional purposes. This promotion will be conducted online and is exclusively for residents of Spain who are of legal age, in accordance with the terms and conditions for participation.

  2. START and END DATES

    The Promotion will begin on April 30th and end on May 2nd. The draw and announcement of the winners will take place on May 2nd.

  3. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

    It is important to emphasize that participation in the Contest implies unconditional acceptance of and compliance with these Official Rules. The participation requirements are as follows:

    ● Participants must reside in Spain and be over 18 years of age. (Except for residents of the Canary Islands, Ceuta, and Melilla).

    ● The personal data provided by participants in the registration form must be truthful.

    ● Participants may only register once for this promotion. The Promotion mechanics consist of taking a screenshot from the promotional video, and also mentioning other real Instagram accounts in the comments of the post announcing the giveaway. This image must be posted to Instagram Stories, tagging the organizing brand. Private Instagram accounts are excluded from the promotion because their participation cannot be verified. To ensure participation, it is necessary to follow the organizing brand's Instagram account, @harperandneyer, as specified in the contest rules on the Instagram post. ● Participants must like the post, follow the brand's Instagram account, and comment with the hashtag #poloharper. ● Participation is not open to anyone belonging to Harper or any of its associated entities. ● All participants who meet the above requirements will be eligible for a 10% discount on a single purchase after subscribing to our newsletter and accepting the terms and conditions. This discount can be applied to purchases over €300 until May 31st.

  4. PROMOTION TERMS AND CONDITIONS AND PRIZES

    Five winners will be chosen. The draw will take place on May 2nd. The selection of winners and alternates will be carried out randomly through a specialized platform that guarantees the transparency of the draw results. As proof of this, the platform issues a certificate of validity for each draw, the results of which cannot be altered by the organizer, and which any participating user can request from the organizer. There will be five winners. The prizes will be gift cards worth €1,000 to use on the Harper & Neyer website. These cards can only be redeemed once and the expiration date is May 31st. The minimum purchase is €300. Any remaining balance after the purchase is completed will be forfeited and cannot be claimed. The winner may contact the Company within 15 days from the date of the announcement on the brand's social media profile by emailing contacto@harperandneyer.com. If no contact is made within the stipulated period, the prize draw will be declared void. The holding of the draw and the awarding of the prize are subject to current tax regulations. LIMITATIONS If it is found that any participant does not meet the requirements stipulated in these Terms and Conditions, or if the information provided for participation is invalid, their participation will be considered null and void, and they will be automatically excluded from the Promotion, forfeiting all rights to any prizes awarded under this Promotion. The prize awarded is non-transferable and cannot be changed, altered, or compensated at the request of the Participants, nor can it be exchanged for any other product or for cash. Harper&Neyer reserves the right, if there is just cause and after providing proper legal notice, to make any changes to, suspend, or extend this Promotion. Any tax or other legally required charges that may arise from accepting the prize, as well as any other expenses related to the promotion not expressly covered by Harper&Neyer in these Terms and Conditions, will be the sole responsibility of the winner. A period of fifteen (15) calendar days from the date the prize is awarded is established for submitting any justified claim. Harper&Neyer reserves the right, if absolutely necessary, to substitute the prize with another of similar characteristics.

  5. POSTING COMMENTS OR OPINIONS

    Comments or opinions whose content is considered inappropriate, offensive, defamatory, or discriminatory, or that could infringe upon the rights of third parties, will not be permitted. Comments against any individual that violate the principles of the right to honor, privacy, and image will not be permitted. We are not responsible for any damages caused by comments made by participants in the Promotion that may offend other participants. Any attempt to disrupt the proper conduct of the Contest, whether through human intervention or by means of an automated system, will result in the immediate disqualification of the participant and the cancellation of their entry. DISCLAIMER OF LIABILITY By way of example, but not limitation, we are not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the conduct of this Promotion. We are also not responsible for the use that the participant makes of the prize obtained from this Promotion, and we assume no liability for any damage or loss of any kind that may be suffered by the Participants, the winner, or third parties. We assume no responsibility in cases of force majeure or unforeseen circumstances that may prevent the execution of the Promotion or the full or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, whether due to detected fraud, technical errors, or any other reason beyond Harper&Neyer's control that affects the normal course of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

  6. FACEBOOK/INSTAGRAM (in the case of promotions on Facebook/Instagram)

    This promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram, and therefore, Participants release Facebook from all liability for any damages that may arise from it.

  7. PERSONAL DATA PROTECTION

    The company responsible for processing your data is Harper&Neyer S.L., with registered office at Calle Nabucco 11 and tax identification number B93269777. Harper&Neyer takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care. In accordance with applicable data protection regulations, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Terms and Conditions, consents to the personal data provided for participation in this contest being incorporated into a file owned by Harper&Neyer to process participation in the contest and to notify the winner of the prize. We inform you that your personal contact details will be used for the following purposes: Marketing purposes. Participants guarantee that the personal data provided is truthful and are responsible for notifying Harper&Neyer of any changes to it. Harper&Neyer reserves the right to exclude from this promotion any Participant who has provided false information. Participants are advised to exercise the utmost diligence regarding Data Protection by using security tools, as Harper&Neyer cannot be held responsible for unlawful data theft, modification, or loss. Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where applicable, request its erasure, (iii) request the restriction of the processing of their data, (iv) object to the processing of their data, and (v) request data portability. Participants may exercise all these rights by sending an email to contacto@harperandneyer.com, indicating the reason for their request. Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State of their habitual residence, place of work, or place of the alleged infringement, if they consider that the processing of their personal data is not compliant with the regulations, or if they are not satisfied with the exercise of their rights. The Supervisory Authority to which the complaint has been submitted shall inform the complainant of the progress and outcome of the complaint. CHANGES We reserve the right to modify or extend these promotional terms and conditions, provided that such modifications or extensions do not prejudice or diminish the rights of the participants in the Promotion. APPLICABLE LAW AND JURISDICTION These terms and conditions shall be governed by Spanish law. The courts of the participant's city shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation, or fulfillment of these terms and conditions.
