  1. Harper&Neyer S.L., with registered office at Calle Nabucco 11 and tax identification number B93269777, is organizing a nationwide sweepstakes (hereinafter, "the Promotion") for promotional purposes. This sweepstakes will be conducted online and is exclusively for residents of Spain who are of legal age, in accordance with the terms and conditions for participation.
  2. START DATE and END DATE
    The Promotion will start on November 25th and end on November 26th. The draw and the announcement of the winners will take place on November 25th and 26th. PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
    It is important to emphasize that participation in the Contest implies unconditional acceptance and respect for the provisions of these Legal Terms and Conditions. The participation requirements are as follows:
    1. ● Participation is open to people who reside in Spain and are over 18 years of age. (Except for residents of the Canary Islands, Ceuta, and Melilla).
    2. ● The personal data provided by participants in the registration form must be truthful.
    3. ● Participants may only register once for this promotion. The promotion involves taking a screenshot of your shopping cart and mentioning other real Instagram accounts in the comments of the post announcing the giveaway. This screenshot must be posted to your Instagram Stories, tagging the organizing brand. Private Instagram accounts are excluded from the promotion because their participation cannot be verified. To ensure participation, it is necessary to follow the organizing brand's Instagram account, @harperandneyer, as specified in the giveaway terms and conditions in the Instagram post.
    4. ●Participants must like the post, upload their shopping cart to their story tagging @harperandneyer, follow the brand's Instagram account, and mention a friend.
    5. ●Participation is not open to anyone belonging to Harper or any of its associated entities.
    6. PROMOTION TERMS AND CONDITIONS AND PRIZES
      50 winners will be chosen. The draw will take place on November 25th and 26th. 25 winners will be chosen each day, and 5 winners will be announced at 12:00 PM, 2:00 PM, 4:00 PM, 5:00 PM, and 7:00 PM. The selection of winners and alternates will be carried out randomly through a specialized platform that guarantees the transparency of the draw results. As proof of this, the platform issues a certificate of validity for each draw, the results of which cannot be altered by the organizer, and which any participating user can request from the organizer. There will be 50 winners. The prizes will be a discount code worth 100 euros to use on the Harper & Neyer website, which can only be redeemed once and cannot be combined with other discounts or promotions. The discount expires on January 1, 2025. Any remaining balance after the purchase is forfeited and cannot be claimed. The winner may contact the Company within 15 days of the announcement on the brand's social media profile by emailing contacto@harperandneyer.com. If no contact is made within this period, the prize draw will be declared void. The draw and the awarding of the prize are subject to current tax regulations.

      If it is found that any of the participants does not meet the requirements stipulated in the Terms and Conditions, or the data provided for participation is invalid, their participation will be considered null and void and they will be automatically excluded from the Promotion, forfeiting all rights to the prizes awarded under this Promotion. The prize awarded is not transferable or subject to changes, alterations, or compensation at the request of the Participants, and cannot be exchanged for any other product or for cash. Harper&Neyer reserves the right, if there is just cause and after prior legal notification, to make any changes to, suspend, or extend this Promotion. Any taxes or duties that acceptance of the prize may entail, as well as any other expenses arising from the promotion not expressly assumed by Harper&Neyer in these Terms and Conditions, will be the sole responsibility of the winner. A period of fifteen (15) calendar days from the date the prize is awarded is established for submitting any justified claim. Harper&Neyer reserves the right, if absolutely necessary, to substitute the prize with another of similar characteristics.
    8. PUBLICATION OF COMMENTS OR OPINIONS

      By way of example, but not limitation, we are not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion, and we assume no responsibility for any damage or harm of any kind that the Participants, winner, or third parties may suffer. We do not assume responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the full or partial enjoyment of the prize. If this Promotion cannot be carried out, whether due to fraud detected within it, technical errors, or any other reason beyond Harper&Neyer's control that affects the normal course of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

In accordance with applicable data protection regulations, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Terms and Conditions, consents to the personal data provided for participation in this contest being incorporated into a file owned by Harper&Neyer for the purpose of processing participation in the contest and to notify the Participant of the prize should they be a Winner. We inform you that your personal contact information will be used for the following purposes: Commercial purposes. Participants guarantee that the personal data provided is truthful and are responsible for notifying Harper&Neyer of any changes to it. Harper&Neyer reserves the right to exclude from this promotion any Participant who has provided false information. Participants are advised to exercise the utmost diligence regarding Data Protection by using security tools, as Harper&Neyer cannot be held responsible for unlawful data theft, modification, or loss. Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its erasure, (iii) request the restriction of the processing of their data, (iv) object to the processing of their data, and (v) request data portability. The Supervisory Authority with which the complaint has been lodged shall inform the complainant of the progress and outcome of the complaint.
    12. CHANGES
       APPLICABLE LAW AND JURISDICTION
      >>These terms and conditions shall be governed by Spanish law. The courts of the participant's city shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation, or fulfillment of these terms and conditions.
