  1. PROMOTION ORGANIZING COMPANY

    The Company Harper&Neyer S.L. with address at 11 Nabucco Street and identification number B93269777, organizes for promotional purposes the nationwide draw (hereinafter, “the Promotion”), to be carried out through the Internet, exclusively for users residing in Spain and of legal age in accordance with the provisions of the conditions section to participate.

  2. START DATE AND END DATE

    The Promotion will start on April 30, and will end on May 2. The drawing and publication of the winners will be on May 2.

  3. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

    It is important to emphasize that participation in the Contest implies unconditional acceptance and respect for the provisions of these Legal Bases. The participation requirements will be the following:

    ● Those who reside in Spain and are over 18 years of age may participate. (Except residents of the Canary Islands, Ceuta and Melilla).

    ● The personal data with which participants fill out the registration form must be truthful data.

    ● Participants may only register once for this promotion. The mechanics of the Promotion consist of capturing an image of the promotional video, where other real Instagram accounts must also be mentioned in the comments of the post in which the giveaway is announced. This image must be posted on Instagram stories tagging the organizing brand. Private accounts on Instagram, since they cannot verify their participation, are excluded from the promotion. To ensure participation, it is necessary to follow the Instagram account of the organizing brand, this being @harperandneyer, as specified in the conditions of the draw in the Instagram post.

    ●Participants have to like the publication, follow the brand's Instagram account, and comment with the hashtag #poloharper.

    ●The participation of any person belonging to Harper or any of its associated structures is exempt.

    ● Any participant who meets the above requirements will be eligible for a 10% discount on a single purchase after subscribing to our newsletter and accepting the conditions. It can be applied to purchases over €300 until May 31. 

  4. CONDITIONS OF THE PROMOTION AND PRIZES

    5 winner/s will be chosen. The draw will be held on May 2. The selection of the winners and substitutes will be carried out randomly through a specialized platform that guarantees the transparency of the result of the draw and as proof of this issues a certificate of validity for each of its draws, the result of which is unalterable by the organizer of the draw, and which any participating user can request from the organizer. There will be 5 winners. The prizes will be gift cards worth 1,000 euros to use on the Harper & Neyer website, which can only be redeemed in a single use and whose term ends on May 31, with the minimum order being 300 euros. The balance remaining after the purchase is completed is lost and cannot be claimed. The winner may contact the Company during a period of 15 days from the date it is announced on the brand's social profile through contacto@harperandneyer.com. If such contact does not occur within the stipulated period, the draw will be declared void. The holding of the draw, as well as the awarding of the prize, are subject to current tax regulations.

  5. LIMITATIONS

    If it is evident that any of the participants does not meet the requirements set out in the Rules, or the data provided to participate is not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion. The prize awarded will not be transferable nor subject to changes, alterations or compensation at the request of the Participants, and cannot be exchanged for any other product or for money. Harper&Neyer reserves the right, if there is just cause and prior communication in legal form, to make any change, suspend or extend this Promotion. Any fiscal or tax burden that acceptance of the prize may entail, as well as any other expense derived from the promotion that is not expressly assumed by Harper&Neyer in these Legal Bases, will be the responsibility of the winner. A period of FIFTEEN (15) calendar days is established from the date of the award of the prize, to make any reasoned claim. Harper&Neyer reserves the right, if necessary, to substitute the prize with another with similar characteristics.

  6. PUBLICATION OF COMMENTS OR OPINIONS

    Comments or opinions whose content is considered inappropriate, that are offensive, libelous or discriminatory or that could violate the rights of third parties will not be permitted. Comments against an individual that violate the principles of the right to honor, personal and family privacy, and one's own image will also not be allowed. We are not responsible for any damage caused by comments made by participants in the Promotion, and which at any time could offend the sensitivity of other participants. Any attempt to hinder the proper development of the Contest, whether by human intervention or by means of an automaton, will result in the immediate disqualification of the participant, canceling his candidacy.

  7. DISCLAIMER

    By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion, and does not assume any responsibility for any damage or harm of any kind that the Participants, winner or third parties may suffer. We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the completion of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of Harper&Neyer and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

  8. FACEBOOK/INSTAGRAM (in case of promotions on Facebook/Instagram)

    The promotion is in no way sponsored, endorsed, administered or associated with Facebook/Instagram, so Participants release Facebook from all liability for any damages arising from it.

  9. PROTECTION OF PERSONAL DATA

    The Company responsible for processing your data is Harper&Neyer S.L. with address at 11 Nabucco Street and identification number B93269777. Harper&Neyer takes the protection of your privacy and your personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care. In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file. ownership of Harper&Neyer to process participation in the contest and to communicate the prize if you are a Winner. We inform you that your personal contact data will be used for the following purposes: Commercial purposes The Participants guarantee that the personal data provided are true and are responsible for communicating to Harper&Neyer any modification thereof. Harper&Neyer reserves the right to exclude from this promotion any Participant who has provided false information. It is recommended to take maximum diligence in matters of Data Protection through the use of security tools, and Harper&Neyer cannot be held responsible for illegal theft, modification or loss of data. Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability. Without prejudice to any other administrative appeal or judicial action, the Participant will have the right to file a claim with a Supervisory Authority, in particular in the Member State in which he has his habitual residence, place of work or place of the alleged infringement, in the event that he considers that the processing of his personal data is not appropriate to the regulations, as well as in the event of not being satisfied with the exercise of his rights. The Control Authority to which the claim has been submitted will inform the claimant about the course and result of the claim.

  10. CHANGES

    We reserve the right to modify or expand these promotional bases, to the extent that it does not harm or undermine the rights of the participants in the Promotion.

  11. APPLICABLE LAW AND JURISDICTION

    These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the Participant's city will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.
